Terms and Conditions

Article 1 – Definitions

In these conditions the following definitions apply:

1. Entrepreneur: B.back
2. Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a Distance Agreement with B.back;
3. Items: the clothing and accessories offered for sale on the Website;
4. Right of withdrawal: the option for the Consumer to cancel the Distance Agreement within the cooling-off period;
5. Distance Agreement: an Agreement in which, within the framework of a system organized by B.back for distance sales of products and/or services, exclusive use is made of distance communication technology (Internet) up to and including the conclusion of the Agreement. / Website);
6. Webshop: the Webshop operated by B.back via the Website.

Article 3 – Applicability

These general terms and conditions apply to every offer from B.back and to every Distance Agreement concluded between B.back and the Consumer. Before the Distance Agreement is concluded, the text of these general terms and conditions will be made available to the Consumer.

Article 4 – The Offer

The Website contains a description of the Items offered that is as complete and accurate as possible. B.back cannot be held to the content of its offers if the Consumer can reasonably understand that the offers, or parts thereof, contain an obvious mistake or error. The Agreement between B.back and the Consumer will not be concluded until the order has been expressly confirmed by B.back to the Consumer by e-mail.

Article 5 – The Agreement

Despite the good quality of the photographed images of the Item(s), the Consumer must take into account the fact that the colors may differ from the actual colors. Where applicable, the dimensions of the Item(s) offered are stated as on the label. If in doubt, the Consumer can contact us via: info@b-back.eu. The Item(s) offered are in good condition and are depicted and/or described as clearly and truthfully as practical. Inherent in used or unused clothing is that it may show signs of wear. When purchasing Item(s) via the Webshop, the Consumer has the option to terminate the Agreement without giving reasons and therefore return the Item(s) during a period of eight working days. This reflection period starts on the day after shipment of the Item(s). Before the expiry of this cooling-off period, the consumer must notify B.back by email or telephone that she/he wishes to exercise his/her right to return the Item(s). During the aforementioned cooling-off period, the Consumer will handle the delivered Item(s), labels and packaging with care. The Consumer will only unpack or use the Item(s) to the extent necessary to assess whether he/she wishes to keep the Item(s). If the Consumer exercises the right of withdrawal, he/she will return the Item(s) with all accessories supplied and in the original condition and packaging to B.back, in accordance with the instructions provided. The costs of return are borne by the Consumer, regardless of the method of return. B.back will refund any amount paid by the Consumer (excluding return shipping costs) as soon as possible, but no later than within 14 days of receipt of the returned Item(s). To be eligible for a refund, the Consumer must return the Item(s) to be returned to B.back as soon as possible, but no later than within eight working days, after the Consumer has indicated, within the cooling-off period of eight working days, the Item(s). s) to return it in the same condition as when received. The Agreement between B.back and the Consumer ends when the Consumer has paid the purchase price of the Item(s) in question and the withdrawal period has expired.

Article 6 – Delivery

The place of delivery is the address that the Consumer has communicated to B.back. The sales price of the Items, as stated on the Website, does not include shipping costs. B.back strives to deliver a sold Item to the Consumer within 7 working days of ordering, unless a longer delivery period has been agreed, but cannot be held liable for any delay in this process. Each shipment is provided with a Track & Trace number, which B.back receives by email and with which it can provide more insight into the status of the shipment via a web link. If a shipment has not arrived after 7 working days, the Consumer must report this via info@b-back.eu. B.back will make every effort to resolve this situation to your satisfaction. If delivery is delayed by more than 20 days, or if the order cannot be fulfilled or can only be partially fulfilled, the Consumer will be notified as soon as possible. In that case, the Consumer has the right to terminate the Agreement without costs, in which case B.back will refund the amount paid by the Consumer (excluding shipping costs) as soon as possible, but no later than 30 days after termination. The consumer is obliged to purchase the Item(s) delivered by B.back at the time they are made available to him/her. If the Consumer refuses to purchase or fails to provide information or instructions necessary for delivery, B.back is entitled to store the Item(s) at the expense and risk of the Consumer. B.back reserves the right to make partial deliveries to the Consumer, so that an order can be sent in two or more shipments.

Article 7- The price and payment

The price that B.back awards to each Item partly depends on the quality, brand, currency and condition of an Item. The prices stated in the Webshop are in Euros, including VAT and excluding shipping costs. After placing an order in the Webshop, B.back confirms this order stating the total costs due including shipping costs. Payment for the ordered Item(s) can be made by direct payment after the order. Delivery of the order will only be initiated after payment has been received.

Article 8 - Liability

B.back is exclusively liable for damage resulting from or related to an attributable shortcoming in the fulfillment of its obligations under an Agreement or tort that has arisen due to intent or gross negligence on the part of B.back. This liability is limited to the amount of the invoice with a maximum of EUR 1,000. B.back's liability ends when the Consumer has paid the purchase price of the Item(s) in question and the withdrawal period of these Terms and Conditions has expired. B.back in no way accepts any liability for the loss of mail items by the logistics service provider. B.back is not liable for any damage or costs resulting from the use of electronic payment methods and electronic means of communication with the Website, including - but not limited to - damage resulting from non-delivery or delay in the delivery of electronic messages, interception or manipulation of electronic messages by third parties or by software or equipment used for electronic communications and transmission of computer viruses. B.back ensures appropriate security based on generally accepted security systems.

Article 9- Force majeure

B.back is not obliged to fulfill any obligation towards the Consumer if it is prevented from doing so as a result of force majeure. Force majeure exists if the shortcoming is the result of circumstances beyond B.back's control, which in any case includes: war or similar situations, riots, strikes, occupation, blockade, failure of suppliers and/or transporters, government measures such as a transport ban, natural disasters, bad weather, lightning, fire and explosion. B.back may suspend the obligations under the Agreement during the period that the force majeure continues. If this period lasts longer than two months, either party is entitled to terminate the Agreement, without obligation to pay compensation to the other party.
